Care farm required to remove personal data of a resident's parents

Joep Bakker wrote a blog for Data&Privacyweb on a ruling by the District Court of Oost-Brabant (Rechtbank Oost-Brabant 12 December 2022, ECLI:NL:RBOBR:2022:5442) concerning a deletion request. (Dutch only)

The District Court of Oost-Brabant ruled on 12 December 2022 that the owner of a care farm must remove the records of the parents of one of its (adult)residents. The care farm had included several notes in the son's file, which were related to his treatment, but which also concerned the parents. In this ruling, the court decided, among other things, that a statutory retention period is not in itself a reason to refuse a request for erasure of personal data.
